Warranty

1. General provisions

As a manufacturer, de Sede AG (FSM) grants its customers a warranty for all products it manufactures during the warranty period. This warranty covers design, manufacturing, processing, and material defects and applies to the purchaser who has acquired the warranted item for private use. The exact terms and conditions of the warranty are set forth in the following provisions.

Important: This manufacturer's warranty expressly applies in addition to and independently of the seller's statutory and/or contractual warranty. However, it is excluded if the buyer claims against the seller for the same defect based on a statutory or contractual warranty. Therefore, the warranty does not affect the buyer's warranty rights against the seller.

2. Assertion of the warranty claim

To assert a warranty claim, the customer must contact the retailer from whom the furniture was purchased. The furniture must be available to verify the warranty claim and, if necessary, to carry out repairs. Under this manufacturer's warranty, the customer is not entitled to reimbursement of costs incurred in connection with the enforcement of their warranty claim (such as telephone and postage costs, travel expenses, etc.), unless de Sede AG has acted in breach of contract.

3. Warranty periods

de Sede AG grants:

• 10-year full warranty on the NECK leather cover

• 5-year full warranty on the general leather cover

• 2-year full warranty on all other products

(taking into account points 4 and 8)
The warranty is subject to normal use and proper care according to the product care instructions. The warranty period begins upon purchase of the product.

4. Excluded damages

The following damages are excluded from the manufacturer’s warranty:

• Damage caused by excessive or improper use

• Damage caused by accidents or force majeure

• Damage caused by non-compliance with de Sede AG's specifications

• Improper use, willful destruction

• Intervention by unauthorized persons or pets

• Transport and fall damage

• Contamination of any kind

• Damage to the cover material caused by sharp, scratching or angular objects

5. Scope of the guarantee obligations

A. de Sede AG provides a full warranty from the date of purchase as described in point 3.
B. If repair is possible, it will be carried out free of charge during the warranty period.
C. If repair is not possible or economically unreasonable, the product will be replaced.
If replacement is not possible or reasonable, a comparable product will be replaced.
Exchange or replacement is free within 5 years.
D. Warranty services are provided in the normal course of business and promptly.
E. The decision regarding repair, exchange or replacement rests with de Sede AG.
F. Repair, exchange or replacement does not commence a new warranty period.

Important: Leather is a natural product. Natural characteristics do not constitute defects.

6. Prohibition of assignment

The buyer’s claims under this manufacturer’s warranty are not transferable without the consent of de Sede AG.

7. Further exclusions

Additionally excluded are:

A. Defects in upholstery materials that are not part of the de Sede AG collection and/or were provided by the customer or ordered upon request.
B. Damage caused by use outside of the private area.
C. Custom-made products according to customer requirements.
D. Defects in quality, suitability or durability of cover materials supplied by the customer.

8. Wear parts

For wear parts such as:

• Joints, hinges, pull-outs, zippers

• Electric motors, electric switches, springs, gas springs

• Foot castors, foot gliders, sliding elements, castors

• Flexible bearings, suspensions, mechanics

The statutory warranty period of 2 years applies. Within this period, replacement will be free of charge. After this period, replacement will be subject to a fee.

9. Expiry of the warranty

The warranty is void if the customer or third parties carry out repairs or modifications without the written consent of de Sede AG.

10. Exclusion of liability for consequential damages

de Sede AG is only liable for the direct costs of rectifying defects. Liability for consequential damages (e.g., loss of use) only applies in the following cases:

• Intention or gross negligence by de Sede AG

• Breach of duty under this guarantee

The buyer’s statutory/contractual rights against the seller remain unaffected.

11. Commercial use

For commercial use of the products, the statutory warranty applies exclusively.

12. Limitation period in case of rejection

If de Sede AG refuses to provide a guarantee, the customer’s claims shall become time-barred within 6 months of receipt of the rejection.
